Jailbreaking iPads Ruled Illegal, Still Legal For iPhones

Jailbreaking iPads Ruled Illegal, Still Legal For iPhones

JassomOctober 25, 2012

In a release today, five exemptions have been added to the Digital Millenium Copyright Act, or DMCA, which prohibits the circumvention of copyright protection, an act which encompasses jailbreaking. One of the new exemptions includes “computer programs that enable wireless telephone handsets to execute lawfully obtained software applications, where circumvention is accomplished for the sole purpose of enabling interoperability of such applications with computer programs on the telephone handset.” However, there is no mention of tablets. This exemption only covers “wireless telephone handsets”, a category that iPads do not fall in to.
Jailbreaker Musclenerd has responded to this ruling with the satement:
Unlocking is no longer an explicit DMCA exemption :( Neither is jailbreaking iPads (important: no exemption != illegal)
So we must wait to see how this will affect the jailbreaking community. Stay tuned for more info soon.
